All prices are F.O.B. Belvidere, Tennessee and are subject to change without notice. The current pricing list cancels all previous quotations.
All orders to established customers are Net 30 unless other arrangements have been made with purchaser. For new customers a 25% cash deposit or satisfactory reference is required before shipment will be made. Overdue accounts are subject to a service charge of 1.5% a month or 18% annually.
We pride our self in exercising the greatest of care in keeping varieties true to name. We give no warranty, expressed or implied, as to life, description, productiveness, or any other matter of any nursery stock or plants that we sell and will not be in any way responsible for the results secured in transplanting. It is mutually agreed that our total liability for any errors, should stock prove untrue to name as labeled, shall be limited upon satisfactory proof, and to our replacing or refunding purchase price. We are not responsible for livability or future growth of plants after leaving our nursery.
With all orders, please specify method of shipment if you do not intend to pick up stock at Walnut Hill Farms. All packing of stock and shipping cost will be at the expense of the buyer. All stock travels at purchaser's risk and expense.
Grades are subject to growth. Grade may change one size on orders unless arranged in advance.
All orders accepted are subject to crop failures or damage by natural causes. We will notify you promptly of unavailability of any product ordered.
Claims must be made in writing within 10 working days after receipt of stock. We will not be liable for any sum greater than the amount received for nursery stock.
The buyer and seller hereto agree that this contract is made in Tennessee and shall be governed under Tennessee law. Furthermore, venue for any action pertaining to a sale made under this contract shall be held in Franklin County, Tennessee Chancery Court. Either party not prevailing in such action shall be liable to the prevailing party for reasonable attorney fees.
